Will of Oliver Montgomery In the Name of God Amen. This Twenth day of December in the year of Our Lord eighteen hundred and eight, I Oliver Montgomery, of Tyrone township, Fayette County and Commonwealth of Pennsylvania being weak in Body but of sound memory and calling to mind the uncertainty of this transitory life and that all flesh must yeald to death when it shall pleaise God to call, Do make and ordain this my last will and Testament thereby revoking and annulling all and every testament and will heretofore by me made either by word or writing and this only to be taken for my last will and Testament and none other and first I will that my Body be buried in such place as it shall please my Executors to appoint and now for the settling of my temporal Estate and such Goods and Chattels and Debts as it hath plaised God to bestow on me. I will that all these Debts and dues that I of right owe to any person or persons whatsoever shall be will and truly paid within a conceivable time after my Decease by my Executors hereafter named. Then I give and Bequeath to my well Beloved wife, Margerett, the one third part of all my moveable property. Then I give and Bequeath all the rest of my real and personal estate to be sold as soon as it can be conceivably done by my Executors and divided equally amongst my wife Margerett and my eight children, viz: Thomas, James, Adam, Martha, Nancy, Jane, Rebecca and Margerett. Further, I appoint and ordain my loving wife Margerett Montgomery and my Brother-in-law Thomas Karr to be my whole and sole Executors of this my last will and Testament. In witness whereof I have therewith set my hand and seal the day and year above written. Oliver Montgomery Signed, Sealed and delivered in presence of us. Before me the subscriber Register for the probate of wills and granting Letters of Administration in and for said County personally gave Matthew Gaut and David Montgomery, two of the signing witnesses to the foregoing last will and Testament on their sworn oaths did respectively declare that they saw the Testator when of sound mind and memory Execute the same as for his last will and Testament and that no undue influence had been used or later will made by him to their knowledge or belief.
